Thank you for this topic. I would like to get information on how to put my case in front of the proper entity. i was suspended by the Texas Medical Board without due process, intentional false statements by the board attorney, and inaccurate complaint by the hospital that filed the complaint. I will not let this go unchecked. The malignant and lawless behavior by the TMB, and the hospital is criminal and resulted in me losing my career. thank you

You are not alone in this widespread disaster. The results which occur are intensely painful, personal, and I’m sorry, but likely quite calculated.

You absolutely need people in your life who understand and believe your story, one that is very hard for many to wrap their heads around.

Dr. Manian’s commentary describes with painful accuracy the many injustices imposed by state medical boards and their associated physician health programs. Every physician in every state is at risk. Whether a doctor has a disability or not, they can be labeled and suffer unbelievable life altering trauma at the whim of their state MLB/PHP twins.

More discussion which clarifies the incentives which drive these violations is in order.

Don't we all! The fact that so few - any? - so-called license defense attorneys even raised the issue of ADA's applicability makes one wonder about the legitimacy of the self-selected specialty. This might be a fine time for the ABA to establish certification training requirements for all who claim such expertise. There are additional laws that govern MLBs and PHPs but you will be hard-pressed to find attorneys who a) know their existence; b) know how to apply them in physicians' defense; and c) have the temerity to advance these arguments.

While this needs to be a separate post, truth be told, the adversarial legal system is also influenced by argument feasibility, affordability, and recognition of the way the system itself is set up. If you're a legal trail-blazer, you're at higher risk of having your argument shot down. Every erudite morsel of legal thought requires oodles of billed time; and, in many cases, will have to go to appeal, and then appeal squared, ad infinitum, because, well, just b/c these entities can bankroll barrister platoons way beyond any individual plaintiff's capacity.
